Terms and Conditions of Sale
The Alnwick Rum and Spirits Company Limited (AR&SC) website provides customer sales of their own products and a few third-party products which we have exclusive rights.
The sales of any goods AR&SC by shall be subject to the following terms and conditions. Nothing in these terms shall affect a customer’s statutory rights as a consumer.
AR&SC supply goods primarily to the UK at this moment in time.
AR&SC reserve the right to contact customers and offer them the product they are attempting to buy at the true price should an error occur in the online shopping system. Our online store provides an invitation to treat, and AR&SC reserve the right to refuse an order and or refund any prepaid monies given to us in advance of receiving products.
Confirmation of Orders
Once an order is received, AR&SC will confirm the acceptance of the order by an e-mail to the customer using the e-mail address provided on the order form. AR&SC’s acceptance of an order brings into existence a legally binding contract (“the Contract”).
Payments
All customer payments are processed via Stripe and for convenience processed by our sister company Lindisfarne Limited, this company’s name will be visible on your bank statement once a payment is processed. Both AR&SC and Lindisfarne Limited are subsidiaries of Harry Hotspur Holdings Limited our group holding company.
Delivery of Goods
Delivery of the goods will be affected as soon as practically possible after an order has been accepted. Where it is impossible to deliver within 30 days of the order, the customer will be informed of this fact and given the option of cancelling the order. Delivery will be to the address provided on the order form.
Availability of Goods
Where goods ordered are unavailable the customer will be notified of that fact and any sums paid will be refunded. In these circumstances AR&SC will not be obliged to offer any additional compensation for any inconvenience or disappointment suffered.
Liability
Nothing in these terms and conditions of sale shall limit or exclude any of AR&SC’s liability for:
(a) Death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors in respect of their own made products;
(b) Fraud or fraudulent misrepresentation; or
(c) Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession) or any other liability which cannot be limited or excluded by applicable law; or
(d) Defective products under the Consumer Protection Act 1987.
Subject to the above, AR&SC shall not be liable to the customer, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
(a) Loss of profits.
(b) Loss of sales or business.
(c) Loss of agreements or contracts.
(e) Loss of use or corruption of software, data or information.
(f) Loss of or damage to goodwill; or
(g) Any indirect or consequential loss.
AR&SC’s total liability to any customer in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the goods purchased.
AR&SC is not responsible for the actions of the couriers, however, subject to photographic proof as outlined below may provide replacement goods. We, however, reserve the right to not replace the damaged goods if we deem the claim to be unfair from the customer. We are also not responsible for issues concerning the content of any sale of a third party-made product bought in by us and sold to a customer.
Cancellation and refund policy
A customer may withdraw/cancel an order at any time up to the end of the fourteenth day after receipt of the goods. A withdrawal/cancellation of an order must be notified either by e-mail or in writing followed by the return of the good(s) (where applicable). Such notification must be received within fourteen days of the customer receiving the goods. A customer does not need to give AR&SC any reason for withdrawing the order but must notify us of the Order Number being returned.
If the customer is claiming a fault on receipt of any goods from us photographic evidence needs to be sent to us to highlight the concern as an immediate first step along with the Order Number. For courier issues we need a photographic sequence showing the external damage before opening and the internal damage after opening the box.
Items may only be returned if the seal remains unbroken and the goods are in the original condition. The customer must supply an order confirmation number in order to receive a refund and must return the goods to St Aidan’s Winery, The Holy Island of Lindisfarne, Northumberland, England TD15 2RX within 14 days of receiving the order. Where orders are cancelled and goods have already been dispatched, AR&SC will refund the cost of the goods less delivery postage.
Jurisdiction and Governing Law
Any sales contract entered into by AR&SC will be governed by and interpreted only in accordance with English law and the English courts shall have exclusive jurisdiction to resolve any dispute between the parties.
Special Offers
From time-to-time AR&SC may create special offers, discounts or other promotional inducements. Such offers will be for limited periods and are only available in respect of transactions made on our online sales system. Such offers are not available to customers in any of our shops unless expressly stated otherwise. Discounts cannot be used in conjunction with existing offers / discounts.
Entire Agreement
These terms and conditions of sale together with the order confirmation shall form the whole agreement relating to the sale of goods by AR&SC
Third party rights
Unless expressly stated otherwise, the Contract does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.
